The lawsuit, unsealed Thursday, describes the scheme as simple, telling the judge ‘there need be no fear of complexity, for there is none.’
Four Donald Trump-licensed real-estate developments are at the center of a huge income tax evasion scheme, according to allegations in a lawsuit unsealed Thursday afternoon by a judge in Manhattan.
The presumptive Republican nominee is not personally accused. He is described as a “material witness” in the evasion of taxes on as much as $250 million in income. According to the court papers, that includes $100 million in profits and $65 million in real-estate transfer taxes from a Manhattan high rise project bearing his familiar name.
However, his status may change, according to the lawyers who filed the lawsuit, Richard Lerner and Frederick M. Oberlander, citing Trump’s testimony about Felix Sater, a convicted stock swindler at the center of the alleged scheme.
Trump received tens of millions of dollars in fees and partnership interests in one of the four projects, the Trump Soho New York, a luxury high rise in lower Manhattan. His son Donald Junior and his daughter Ivanka also were paid in fees and partnership interests, the lawyers said, and are also material witnesses in the case.
Trump and Sater traveled extensively together and were photographed and interviewed in Denver and Loveland, Colorado, Phoenix, Fort Lauderdale, and New York. The two Trump children were also with Sater in Moscow, Alan Garten, the Trump Organization general counsel, has said.
Trump has testified about Sater in a Florida lawsuit accusing the two of them of fraud in a failed high-rise project. Trump testified that he had a glancing knowledge of Sater and would not recognize him if he were sitting in the room.
Sater controlled an investment firm named Bayrock, with offices in Trump Tower, and sought to develop branded Trump Tower luxury buildings in Moscow and other cities. Court papers show his salary in 2006 was $7 million, but it alleges that was a pittance compared to his real income.
Sater then moved into the Trump Organization offices. He carried a business card, issued by the Trump Organization, identifying him as a “senior adviser” to Trump.
The tax fraud lawsuit included 212 pages of documents, among them a flow chart that the plantiff claims showed how the scheme worked. The lawsuit alleges the tax fraud scheme as simple, telling the judge “there need be no fear of complexity, for there is none.”
The four developments were all handled as partnerships. Partnerships are not taxed and are rarely audited because the profits are supposed to be reported as going to the partners personally. The lawsuit says the profits simply were not reported when Sater and others took their partnership profits and other income from the deals.
The state tax fraud lawsuit is known as a qui tam case in which citizens file as private attorneys general on behalf of the government. In effect Lerner and Oberlander are acting as prosecutors in the alleged tax fraud.
Eric Schneiderman, the New York State attorney general, learned of the case soon after it was filed in state court last August and declined to intervene. His office confirmed that stance Thursday after the lawsuit was unsealed.
The suit says Sater and other defendants owe at least $7 million in New York state income taxes, a sum that would be tripled if they prevail.
If the federal government were to intervene the federal taxes would come to about $35 million.
New York state tax law closely aligns with federal tax law in defining income, deductions, and taxes due.
The case was unsealed after Sater filed an action in Israel against a rabbi who says he was cheated in a $40 million stock swindle. That was enough to persuade a federal judge to unseal another lawsuit against Sater, Bayrock, and others earlier in July. And in turn that disclosure prompted the state Supreme Court (trial court) judge in Manhattan to unseal the tax evasion lawsuit.
Sater secretly pleaded guilty to the stock swindle in 1998. The $40 million fleeced from investors went to him, the Genovese and Gambino crime families and others.
In 1998 Sater pleaded guilty in federal court, but the plea was kept secret. Sater was sentenced in secret in 2009 to probation and a $25,000 fine with no jail time and no requirement to make restitution.
That was an extraordinarily light sentence, especially given Sater’s violent past. In 1991 he admitted to shoving the broken stem of a margarita glass into a man’s face and was sentenced to two years.
Court papers, testimony by Trump and a book by one of Sater’s confederates—The Scorpion and the Frog, “The True Story of One Man’s Fraudulent Rise and Fall on the Wall Street of the Nineties”—all tell how after his arrest Sater became an operative for the Central Intelligence Agency, supposedly buying missiles on their way to terrorists, which may explain the light sentence.
As to Trump, every president starting with Richard Nixon and major party candidate since has made public some or all of their tax returns. He has not, even as Hillary Clinton has released her complete tax returns going back more than three decades.
Trump has explained his refusal to make his income tax returns public by claiming that the ones he has filed for 2012 and since are under routine audit. Mark Everson, a former commissioner of Internal Revenue has said there is no reason to hold the returns back, even assuming they are being audited.
He has offered no explanation for not releasing his returns for 2011 and earlier, years on which he has said the audits are closed.
Documents made public by the New Jersey Casino Control Commission show that despite living a lavish lifestyle, Trump did not pay income taxes in 1978, 1979, 1992, and 1994. He also paid no income taxes in 1984, by far his most lucrative year in his career to that point, according to state and city tax tribunal proceedings I reported on previously.
Wherever crowds gathered in the flat, lake-dotted swath of Florida between Orlando and Ocala, it seemed that Cheryl Hall was there: clad in red, white and blue, clipboard in hand, signing up new voters at the Mount Dora Arts Festival, the Ocoee Founders’ Day party, the Taste of South Lake fair in Clermont and more.
“She just seemed like a diligent, hard-working lady,” said Alan Hays, the supervisor of elections in Lake County, who appears in a photo on Ms. Hall’s Facebook page, his arm firmly clasped around her shoulder. “No one suspected anything was amiss until we got phone calls from people.”
Something was indeed amiss: Ms. Hall, a 63-year-old and very ardent Republican whose ranch house in Clermont sports life-size cutouts of Donald and Melania Trump and a MAGA poster in the window, was charged last week with 10 felony counts of submitting false voter registration forms. On at least 10 forms traced to Ms. Hall, officials said, the party affiliations of already-registered Democrats and Independents had been switched to Republican. More than 100 others that may be tied to her contained missing or bogus data such as wrong birth dates.
Ms. Hall was a canvasser for Florida First Inc., a recently created nonprofit that is financed at least in part by a dark-money group formed by Mr. Trump’s re-election campaign manager, Brad Parscale, and other Trump associates.
The Florida nonprofit group, which has filed more than 30,000 new registrations according to the Florida secretary of state, is part of a $20 million bid by the group, America First Policies, to register Republicans in battleground states before November. State officials have said there is no evidence so far of widespread fraud in Florida First’s voter-registration efforts.
But the improprieties of which Ms. Hall stands accused are hardly unheard of in voter-registration drives — particularly those that, like Florida First, have partisan backing. Signing up new voters is a low-paying temp job that requires few skills, and in states that allow it (Florida does not), workers have quotas or are offered cash incentives to sign up as many new registrants as possible.
The result is a small but steady trickle of fraudulent registrations, enough to demand added vigilance by election officials, but rarely to pose any serious threat to election integrity. Republicans have been most vocal about allegations of voter fraud, but Ms. Hall’s case is a reminder that neither party has a monopoly on virtue.
In north Florida’s Leon County, home to the state capital, Tallahassee, authorities are scrutinizing registrations by a liberal-backed nonprofit in which two voters have complained that their party registrations were switched and one newly registered voter was found to be dead, as first reported by the Miami Herald.
Lake County officials have said they still are not certain what prompted the bogus forms attributed to Ms. Hall, which contained such obvious errors that they were quickly caught.
Florida court records suggest her life has been checkered by both financial and legal problems, including a 2003 charge of unemployment compensation fraud, which resulted in probation, and a 2014 arrest for stealing donations from the Salvation Army. That charge was dropped after she entered a pretrial diversion program.
Ms. Hall was active in local Republican Party circles, and her Facebook page was festooned with photographs — some of which have been recently removed — of her posing with conservative luminaries, such as Donald Trump Jr., Sean Hannity, Roger J. Stone Jr. and the state’s Republican governor, Ron DeSantis.
She was a member of the Lake County Republican Party county executive committee, in charge of getting out the vote in her precinct, said Walter B. Price, Sr., chairman of the county party. He said proceedings have begun to remove her from those posts.
Ms. Hall did not respond to requests for comment, including a note left at her house.
Mr. Hays, the Lake County election supervisor, said she helped file more than 500 registration forms in his county alone before being arrested.
“We already had extensive quality control measures in place that helped us assist the supervisor of elections in their investigation,” said Chris Gober, Florida First’s attorney, adding that there is no financial incentive for any canvassing employee to rack up additional voter registration applications. “Our mission is to register voters and ensure that every Florida resident has an opportunity to vote, regardless of ideology or political affiliation.”
Mr. Hays said Florida First traced the questionable forms to Ms. Hall because they included a number assigned to her for registration work. He said he hopes to meet with other election officials and voter groups soon to “find out what measures we can take to prevent this from happening again.”
The most cited example of registration irregularities involved the left-leaning community organizing group commonly known as ACORN whose registration drives became a target of fraud accusations by Republicans during the 2008 presidential campaign. The group said it had hired 13,000 registration canvassers and signed up 1.3 million new voters in 2007 and 2008; a handful of those workers were found guilty of fraud, such as registering children and nonexistent voters.
The group said most charges were politically inflated — in some cases, it maintained, workers were cited for bogus registrations that they actually had flagged for election workers. But it said in a statement in 2008 that “in any endeavor of this size, some people will engage in inappropriate conduct.” The controversy forced ACORN to shut down in 2010.
Other examples have occurred over time: a Los Angeles voter drive that paid $2.50 in 1992 for each new registration and enrolled a dead person and a baby; an Orange County, Calif., drive in 2006 by a Republican contractor that switched 65 voters from Democrats to Republicans; a 2010 campaign by a pro-Democrat labor union that filed as many as a thousand suspicious forms; a Pennsylvania college student who pleaded guilty in 2017 to creating 18 fake registrations to help a co-worker meet a quota.
While such fraud is a serious matter, it generally poses a less serious threat to the integrity of elections, said David J. Becker, the director of the Center for Election Innovation and Reform, who helped create a clearinghouse for verifying voter registrations that is used by election officials nationwide.
“Election officials have to be vigilant against such attacks, and in this case, they were,” he said in an email. “I think the likelihood of detecting an attack like this is very high, as is the chance to mitigate any negative impacts, even if it makes things more difficult for election officials. But in this era of foreign interference and win-at-all-costs partisanship, add this to the list of things that election officials are worrying about.”
The cases have often fueled a political divide between Democrats who have long relied on sign-ups of new voters to build their ranks and Republicans, whose supporters historically tended to be better educated and more likely to register without prompting.
Texas Republicans enacted perhaps the nation’s strictest curbs on voter registration drives. Florida’s Republican-dominated legislature crimped Democratic registration efforts in the 2012 campaign season by enacting such tough restrictions on signing up voters that some groups gave up. The law later was overturned in court.
Erik Prince, the security contractor with close ties to the Trump administration, has in recent years helped recruit former American and British spies for secretive intelligence-gathering operations that included infiltrating Democratic congressional campaigns, labor organizations and other groups considered hostile to the Trump agenda, according to interviews and documents.
One of the former spies, an ex-MI6 officer named Richard Seddon, helped run a 2017 operation to copy files and record conversations in a Michigan office of the American Federation of Teachers, one of the largest teachers’ unions in the nation. Mr. Seddon directed an undercover operative to secretly tape the union’s local leaders and try to gather information that could be made public to damage the organization, documents show.
Using a different alias the next year, the same undercover operative infiltrated the congressional campaign of Abigail Spanberger, then a former C.I.A. officer who went on to win an important House seat in Virginia as a Democrat. The campaign discovered the operative and fired her.
Both operations were run by Project Veritas, a conservative group that has gained attention using hidden cameras and microphones for sting operations on news organizations, Democratic politicians and liberal advocacy groups. Mr. Seddon’s role in the teachers’ union operation — detailed in internal Project Veritas emails that have emerged from the discovery process of a court battle between the group and the union — has not previously been reported, nor has Mr. Prince’s role in recruiting Mr. Seddon for the group’s activities.
Both Project Veritas and Mr. Prince have ties to President Trump’s aides and family. Whether any Trump administration officials or advisers to the president were involved in the operations, even tacitly, is unclear. But the effort is a glimpse of a vigorous private campaign to try to undermine political groups or individuals perceived to be in opposition to Mr. Trump’s agenda.
Mr. Prince, the former head of Blackwater Worldwide and the brother of Education Secretary Betsy DeVos, has at times served as an informal adviser to Trump administration officials. He worked with the former national security adviser Michael T. Flynn during the presidential transition. In 2017, he met with White House and Pentagon officials to pitch a plan to privatize the Afghan war using contractors in lieu of American troops. Jim Mattis, then the defense secretary, rejected the idea.
Mr. Prince appears to have become interested in using former spies to train Project Veritas operatives in espionage tactics sometime during the 2016 presidential campaign. Reaching out to several intelligence veterans — and occasionally using Mr. Seddon to make the pitch — Mr. Prince said he wanted the Project Veritas employees to learn skills like how to recruit sources and how to conduct clandestine recordings, among other surveillance techniques.
James O’Keefe, the head of Project Veritas, declined to answer detailed questions about Mr. Prince, Mr. Seddon and other topics, but he called his group a “proud independent news organization” that is involved in dozens of investigations. He said that numerous sources were coming to the group “providing confidential documents, insights into internal processes and wearing hidden cameras to expose corruption and misconduct.”
“No one tells Project Veritas who or what to investigate,” he said.
A spokesman for Mr. Prince declined to comment. Emails sent to Mr. Seddon went unanswered.
Mr. Prince is under investigation by the Justice Department over whether he lied to a congressional committee examining Russian interference in the 2016 election, and for possible violations of American export laws. Last year, the House Intelligence Committee made a criminal referral to the Justice Department about Mr. Prince, saying he lied about the circumstances of his meeting with a Russian banker in the Seychelles in January 2017.
Once a small operation running on a shoestring budget, Project Veritas in recent years has had a surge in donations from both private donors and conservative foundations. According to its latest publicly available tax filing, Project Veritas received $8.6 million in contributions and grants in 2018. Mr. O’Keefe earned about $387,000.
Last year, the group received a $1 million contribution made through the law firm Alston & Bird, a financial document obtained by The New York Times showed. A spokesman for the firm said that Alston & Bird “has never contributed to Project Veritas on its own behalf, nor is it a client of ours.” The spokesman declined to say on whose behalf the contribution was made.
The financial document also listed the names of others who gave much smaller amounts to Project Veritas last year. Several of them confirmed their donations.
The group has also become intertwined with the political activities of Mr. Trump and his family. The Trump Foundation gave $20,000 to Project Veritas in 2015, the year that Mr. Trump began his bid for the presidency. The next year, during a presidential debate with Hillary Clinton, Mr. Trump claimed without substantiation that videos released by Mr. O’Keefe showed that Mrs. Clinton and President Barack Obama had paid people to incite violence at rallies for Mr. Trump.
In a book published in 2018, Mr. O’Keefe wrote that Mr. Trump years earlier had encouraged him to infiltrate Columbia University and obtain Mr. Obama’s records.
Last month, Project Veritas made public secretly recorded video of a longtime ABC News correspondent who was critical of the network’s political coverage and its emphasis on business considerations over journalism. Many conservatives have gleefully pounced on Project Veritas’s disclosures, including one particularly influential voice: Donald Trump Jr., the president’s eldest son.
The website for Mr. O’Keefe’s coming wedding listed Donald Trump Jr. as an invited guest.
Mr. Prince invited Project Veritas operatives — including Mr. O’Keefe — to his family’s Wyoming ranch for training in 2017, The Intercept reported last year. Mr. O’Keefe and others shared social media photos of taking target practice with guns at the ranch, including one post from Mr. O’Keefe saying that with the training, Project Veritas will be “the next great intelligence agency.” Mr. Prince had hired a former MI6 officer to help train the Project Veritas operatives, The Intercept wrote, but it did not identify the officer.
Mr. Seddon regularly updated Mr. O’Keefe about the operation against the Michigan teachers’ union, according to internal Project Veritas emails, where the language of the group’s leaders is marbled with spy jargon.
They used a code name — LibertyU — for their operative inside the organization, Marisa Jorge, who graduated from Liberty University in Virginia, one of the nation’s largest Christian colleges. Mr. Seddon wrote that Ms. Jorge “copied a great many documents from the file room,” and Mr. O’Keefe bragged that the group would be able to get “a ton more access agents inside the educational establishment.”
The emails refer to other operations, including weekly case updates, along with training activities that involved “operational targeting.” Project Veritas redacted specifics about those operations from the messages.
In August 2017, Ms. Jorge wrote to Mr. Seddon that she had managed to record a local union leader talking about Ms. DeVos and other topics.
“Good stuff,” Mr. Seddon wrote back. “Did you receive the spare camera yet?”
As education secretary, Ms. DeVos has been a vocal critic of teachers’ unions, saying in 2018 that they have a “stranglehold” over politicians at the federal and state levels. She and Mr. Prince grew up in Michigan, where their father made a fortune in the auto parts business.
AFT Michigan sued Project Veritas in federal court, alleging trespassing, eavesdropping and other offenses. The teachers’ union is asking for more than $3 million in damages, accusing the group of being a “vigilante organization which claims to be dedicated to exposing corruption. It is, instead, an entity dedicated to a specific political agenda.”
Project Veritas has said its activities are legal and protected by the First Amendment, and the case is scheduled to go to trial in the fall.
Other Project Veritas employees on the emails include Joe Halderman, an award-winning former television producer who in 2010 pleaded guilty to trying to extort $2 million from the comedian David Letterman. Mr. Halderman was copied on several messages providing updates about the Michigan operation, and in one message, he gave instructions to Ms. Jorge. Project Veritas tax filings list Mr. Halderman as a “project manager.”
Two other employees, Gaz Thomas and Samuel Chamberlain, were also identified in emails and appeared to play important roles in the Michigan operation. Efforts to locate Mr. Thomas were unsuccessful. A man named Samuel Chamberlain who matched the description of the one employed by Mr. O’Keefe denied he worked for Project Veritas. He did not respond to follow-up phone messages or an email.
Last year, Project Veritas submitted a proposed list of witnesses for the trial over the lawsuit. Mr. Chamberlain and Mr. Thomas were on the list. Mr. Seddon was not.
Ms. Jorge, 23, did not respond to email addresses associated with her Liberty University account. In an archived version of her LinkedIn page, Ms. Jorge wrote she had a deep interest in the conservative movement and hoped one day to serve on the Supreme Court after attending law school.
In a YouTube video, Mr. O’Keefe described the lawsuit as “frivolous” and pointed to a portion of the deposition in which David Hecker, the president of AFT Michigan, said that one of the goals of the lawsuit was to “stop Project Veritas from doing the kind of work that it does.”
Randi Weingarten, the president of the American Federation of Teachers, said in a statement: “Let’s be clear who the wrongdoer is here: Project Veritas used a fake intern to lie her way into our Michigan office, to steal documents and to spy — and they got caught. We’re just trying to hold them accountable for this industrial espionage.”
In 2018, Ms. Jorge infiltrated the congressional campaign of Ms. Spanberger, posing as a campaign volunteer. At the time, Ms. Spanberger was running to unseat a sitting Republican congressman in a race both parties considered important for control of the House. Ms. Jorge was eventually exposed and kicked out of the campaign office.
It was unclear whether Mr. Seddon was involved in planning that operation.
Mr. Seddon was a longtime British intelligence officer who served around the world, including in Washington in the years after the attacks of Sept. 11, 2001. He is married to an American diplomat, Alice Seddon, who is serving in the American consulate in Lagos, Nigeria.
Mr. O’Keefe and his group have taken aim at targets over the years including Planned Parenthood, The New York Times, The Washington Post and Democracy Partners, a group that consults with liberal and progressive electoral causes. In 2016, a Project Veritas operative infiltrated Democracy Partners using a fake name and fabricated résumé and made secret recordings of the staff. The year after the sting, Democracy Partners sued Project Veritas, and its lawyers have since deposed Mr. O’Keefe.
In that deposition, Mr. O’Keefe defended the group’s undercover tactics, saying they were part of a long tradition of investigative journalism going back to muckraking reporters like Upton Sinclair. “I’m not ashamed of the methods that we use or the recordings that we use,” he said.
He was asked whether he had provided any of the group’s secret recordings of Democracy Partners to the Republican National Committee or any member of the Trump family. He said that he did not think so.
In 2010, Mr. O’ Keefe and three others pleaded guilty to a federal misdemeanor after admitting they entered a government building in New Orleans under false pretenses as part of a sting.
