Here are just some of the prohibitions against atheists
Be Denied the right to hold public office and even the right to be a witness in court
The “No Religious Test Clause” of the United States Constitution, which is found in Article VI, paragraph 3, and states that:
The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the United States.
And yet? The following states have laws on their books that prohibit atheists from running for or holding elected office. And some of these laws deny atheists the right to even be a witness in a court of law.
Arkansas, Article 19, Section 1:
No person who denies the being of a God shall hold any office in the civil departments of this State, nor be competent to testify as a witness in any Court.
Maryland, Article 37:
That no religious test ought ever to be required as a qualification for any office of profit or trust in this State, other than a declaration of belief in the existence of God; nor shall the Legislature prescribe any other oath of office than the oath prescribed by this Constitution.
Mississippi, Article 14, Section 265:
No person who denies the existence of a Supreme Being shall hold any office in this state.
North Carolina, Article 6, Section 8
The following persons shall be disqualified for office: Any person who shall deny the being of Almighty God.
South Carolina, Article 17, Section 4:
No person who denies the existence of a Supreme Being shall hold any office under this Constitution.
Tennessee, Article 9, Section 2:
No person who denies the being of God, or a future state of rewards and punishments, shall hold any office in the civil department of this state.
Texas, Article 1, Section 4:
No religious test shall ever be required as a qualification to any office, or public trust, in this State; nor shall any one be excluded from holding office on account of his religious sentiments, provided he acknowledge the existence of a Supreme Being.
Not believing in God is such a volatile political issue that a simple meeting with people who have ties to atheist groups can expose a candidate to a brutal smear campaign.

Be denied custody of their children
Over the past few decades, there have been many documented cases of judges either denying parents custody rights because of their apparent disinterest in organized religion, or in other cases, of atheist parents being ordered to attend church so that their children can undergo “systematic spiritual training.”
In 2006, an atheist father emailed The Dish columnist Andrew Sullivan to describe a custody battle that had seen his Sunday visitation rights revoked so that his son could receive “religious instruction” under his ex-wife’s supervision. The case took place in Mississippi, and the father said that he feared he would only lose more ground if he challenged the religious judge’s ruling.

Dealing with constant violations of the Establishment Clause
While the Establishment Clause of the Constitution is supposed to ensure a clear separation of church and state, the two frequently intermix, much to the disapproval of nonbelievers.
This manifests itself in a variety of ways, from the inclusion of the word “God” in various mandatory pledges and on the face of U.S. currency, to compulsory religious-based sessions that atheists have been unconstitutionally forced to take part in.
While these cases are relatively common — and it appears that a nonbeliever somewhere is always locked in a legal battle to remove religious language and imagery from the public sphere — there are a few brazen examples that show the extremes of this issue. In Arizona last year, Republicans proposed a bill to require high school students to recite a pledge before receiving their diplomas. That oath included the words, “so help me God,” and gave students no chance to opt out. While the sponsors eventually said they’d be willing to change the nature of the pledge, the bill failed.
And in South Carolina earlier this year, lawmakers again submitted a bill that would mandate daily prayer sessions in public schools. In that case, atheists or anyone objecting could leave the classroom if they pleased.
Atheist soldiers are heckled, insulted and denigrated and denied participation, even in the military by their own fellow soldiers and officers.
Atheists are apparently so detestable that a group of military veteran nonbelievers was repeatedly heckled and berated in 2011 during a Memorial Day parade. Apparently supporting the troops comes with a big asterisk, which maybe isn’t a shock, considering the military’s own record of discriminating against service members who don’t believe in God.
Atheists Face Death Penalty In 13 Countries, Discrimination Around The World According To Freethought Report
In 13 countries around the world, all of them Muslim, people who openly espouse atheism or reject the official state religion of Islam face execution under the law, according to a detailed study issued on Tuesday.
And beyond the Islamic nations, even some of the West’s apparently most democratic governments at best discriminate against citizens who have no belief in a god and at worst can jail them for offenses dubbed blasphemy, it said.
The study, The Freethought Report 2013, was issued by the International Humanist and Ethical Union (IHEU), a global body uniting atheists, agnostics and other religious skeptics, to mark United Nations’ Human Rights Day on Tuesday.
“This report shows that the overwhelming majority of countries fail to respect the rights of atheists and freethinkers although they have signed U.N agreements to treat all citizens equally,” said IHEU President Sonja Eggerickx.
The study covered all 192 member states in the world body and involved lawyers and human rights experts looking at statute books, court records and media accounts to establish the global situation.
A first survey of 60 countries last year showed just seven where death, often by public beheading, is the punishment for either blasphemy or apostasy – renouncing belief or switching to another religion which is also protected under U.N. accords.
But this year’s more comprehensive study showed six more, bringing the full list to Afghanistan, Iran, Malaysia, Maldives, Mauritania, Nigeria, Pakistan, Qatar, Saudi Arabia, Somalia, Sudan, United Arab Emirates and Yemen.
In others, like India in a recent case involving a leading critic of religion, humanists say police are often reluctant or unwilling to investigate murders of atheists carried out by religious fundamentalists.
Across the world, the report said, “there are laws that deny atheists’ right to exist, revoke their citizenship, restrict their right to marry, obstruct their access to public education, prevent them working for the state….”
Criticism of religious faith or even academic study of the origins of religions is frequently treated as a crime and can be equated to the capital offense of blasphemy, it asserted.
EU STATES OFFEND
The IHEU, which has member bodies in some 50 countries and supporters in many more where such organizations are banned, said there was systematic or severe discrimination against atheists across the 27-nation European Union.
The situation was severe in Austria, Denmark, Germany, Greece, Hungary, Malta and Poland where blasphemy laws allow for jail sentences up to three years on charges of offending a religion or believers.
In these and all other EU countries, with the exception of the Netherlands and Belgium which the report classed as “free and equal,” there was systemic discrimination across society favoring religions and religious believers.
In the United States, it said, although the situation was “mostly satisfactory” in terms of legal respect for atheists’ rights, there were a range of laws and practices “that equate being religious with being American.”
In Latin America and the Caribbean, atheists faced systemic discrimination in most countries except Brazil, where the situation was “mostly satisfactory,” and Jamaica and Uruguay which the report judged as “free and equal.”
Across Africa, atheists faced severe or systemic violations of their rights to freedom of conscience but also grave violations in several countries, including Egypt, Libya and Morocco, and nominally Christian Zimbabwe and Eritrea.
Other laws in the United States against atheists and agnostics
Atheists and agnostics have suffered discrimination under the early laws of individual states in the colonies, and also from subtler, but insidious discrimination from our courts for many years, to the present day. In American legal history, atheists have not been trusted to give testimony under oath or serve on a jury. “As of 1938, seven states explicitly prohibited testimony from anyone professing disbelief. Eight others allowed impeachment of the witness based on his or her disbelief.” Dying declarations were not considered acceptable when atheists made them, apparently based on the notion that they might be lying because they did not fear punishment in an afterlife. Dying declarations have often been considered admissible by the courts because the dying person presumably has nothing to lose, and being so close to death, would not wish to imperil his/her immortal soul. The dying declaration of an atheist who told his sons who had shot him was remanded back to trial court in 1920 with instructions that the victim’s atheism should be admitted and used to help undermine his credibility. David Koepsell states that as late as 1953, eight state constitutions required belief in god to hold public office.
